Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement ("Agreement") between you and Cubicle 7 Entertainment Ltd

When these Terms mentions ”Cubicle 7," "we," "us," or "our," it refers to Cubicle 7 Entertainment Ltd Ireland. If you use any of our services, we will refer to you using the terms "user", "visitor", "you", "your", "yours" in these Terms.

This website is owned and run by Cubicle 7 a limited company incorporated in Ireland. Our registered address is Unit 5/6, Balbriggan Business Campus, Balbriggan, Co.Dublin, Ireland.  Cubicle 7 produces games, advertises, sells and fulfills orders on behalf of Cubicle 7 Entertainment Ltd UK.

Ordering

By placing an order you are offering to purchase a product. All orders are subject to availability and confirmation of the order price. 

In order to buy from us you must be over 18 years of age and possess a valid credit or debit card, or a Paypal account. If your order is accepted, we will inform you by email.  Your credit/debit card payment will be made through a secure Website.

When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card or Paypal account used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Websites may not be suitable for children under 18 years of age. 

After placing an order, you will receive an email from us acknowledging that we have received your order (the “Order Confirmation”).  Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product or service. All orders are subject to acceptance and we will confirm such acceptance to you by sending you an email that confirms that the products have been dispatched (the “Dispatch Confirmation”).

The contract between us (the “Contract”) will only be formed when we send you the Dispatch Confirmation. The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation.

We try and ensure that all details, descriptions and prices which appear on this Website are accurate, however errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. 

If any personal information or delivery information changes, please contact our Customer Service team or update your online account details.

Pricing

The prices on the Website are subject to VAT in certain regions (where applicable) and exclude delivery costs, which will be added to the total amount due as set out in our Delivery Costs Guide. Prices are liable to change at any time, but (other than as set out above) changes will not affect orders in respect of which we have already sent you an Order Confirmation.

Payment

Card payments are subject to validation checks and authorisation by your card issuer. If your card issuer fails to authorise the payment to us, we will not be liable for any delay or non-delivery and may not be able to proceed with your order.

Updating the website

We reserve the right to withdraw any products from this Website at any time and / or remove or edit any materials or content on this Website.

The Website may contain inaccuracies, typographical errors or other errors and may not always be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the Website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Refunds and Returns

Refunds may be issued within 28 days of the purchase date for products of saleable quality that are returned in their original condition, in original packaging, and accompanied by the relevant dispatch note. This does not affect your statutory rights in relation to faulty, damaged, or incorrectly supplied goods. All approved refunds are issued to the original method of payment. Please contact our Customer Service Team before returning any items.

Please note that books include PDFs, which are non-refundable. Where an order is cancelled after a PDF has been accessed or downloaded, the cost of the PDF will be deducted from any refund.

You may cancel and receive a refund for physical orders prior to shipment. If an order includes downloadable content that has already been accessed, the refund amount will be reduced by the value of the digital content. For physical returns, customers are responsible for return shipping costs. Once the returned item has been received and inspected and confirmed to be in its original purchased condition, a refund will be processed accordingly.

EU Consumer Rights Directive

The EU Consumer Rights Directive allows our EU based customers to cancel an order at any time within 14 days, beginning on the day after you received the products. If you have purchased products from us and if you decide to cancel your order under this rule, you must advise us within 14 days of receipt of the products. Email [email protected] stating your wish to cancel your contract and quoting your order reference number.

You must return the items to us at the above address. You will be responsible for any cost incurred or risk in returning products. You have a legal obligation to take reasonable care of the products while they are in your possession and you will be responsible for any diminished value of the goods resulting from the handling of the goods beyond that necessary to establish their nature, characteristics and functioning.

Delivery

Subject to availability we will endeavour to fulfil your order for product(s) within a reasonable period of time unless there are exceptional circumstances. If for any reason we cannot meet the expected delivery date, you will be kept informed and offered a choice of either continuing with the extended delivery time or cancellation with a full refund.

Once your order has been dispatched we will email you the details of your order to the email address provided.

If your delivery address is outside of the EU, you may have to pay import duties and taxes, which are levied once a shipment reaches your country. You are responsible for payment of any additional charges for customs clearance. Please note that customs policies vary widely from country to country. We recommend you contact your local customs office for further information.

Faulty/incorrect products received 

In the unlikely event that you have received the wrong products or that the products are faulty or damaged in any way please contact our Customer Service Team.

Please Note:

In case of faulty or damaged goods, we may offer a free replacement or a refund option. However, we will request detailed photographic evidence of the damage for our records and will be dealt with on a case by case basis.

Undeliverable Shipments

When packages are returned to us as undeliverable, we will attempt to contact you via phone or e-mail in order to obtain a different shipping address to re-ship the order.

Jurisdiction

We are governed by and in accordance with the laws of the Republic of Ireland and all disputes will be referred to the exclusive jurisdiction of the Irish Courts.

 

UK Tax & VAT Information

Orders shipped to the UK from Ireland are subject to UK import rules following Brexit.

  • Books are zero-rated for VAT in the UK, so no UK VAT is charged on book-only orders. Games and other non-book items are subject to UK VAT at the applicable rate.
  • For orders with a total value of £135 or less, UK VAT is collected at checkout where applicable, and no additional charges should be due on delivery.
  • For orders with a total value over £135, UK customs rules apply. Import VAT and, where relevant, customs duties may be charged by the courier or UK customs authorities before delivery. These charges are outside of our control and are the responsibility of the customer.
  • If an order contains a mix of VAT-exempt books and VATable game products, UK VAT will apply only to the VATable items.
